Fraud trial councillor lied about bank cash and partner, claims son

THE son of an Inverness councillor facing fraud charges insisted that his father did know that the proceeds of the sale of a house were going to be paid into his bank account.

And Sean Holden in evidence at Inverness Sheriff Court today said a woman, who is now his father’s wife, lived in the same house with him as far back as 1999.

John Holden (63), of 8 Teal Avenue, Inverness, denies falsely claiming benefits from the Department of Work and Pensions and Highland Council tax relief worth over £43,000 to which he was not entitled by failing to disclose, earnings, capital and the fact he was living with a partner. He also denies failing to inform the authorities of his change in circumstances.

Holden is a Highland Council member for Inverness South.

Evidence was concluded today when the Crown was given permission to call Sean Holden as an additional prosection witness.

Sean Holden (39) could not be contacted by the prosecution prior to the trial.

He was living back in the Republic of Ireland but got in touch with the fiscal’s office last week after reading press coverage of the case.

His father had claimed in his evidence that he was unaware that the sum of £65,000 was going to be paid into his account from the proceeds of a house sale in Balnafettack Road by Sean Holden’s partner, Donna Wilson.

But when he took the witness stand today Sean Holden said father knew all about the arrangement.

Asked by Depute Fiscal Ian Smith what made him contact his office regarding the case.

"It was when he (John Holden) said if he gets his hands on me I’m a dead man," he told the court.

Sean Holden told the court that he and his partner were in financial difficulties after Donna’s business failed. He said her bank account wasn’t serviceable and they needed somewhere to put the money.

"He gave Donna his bank account number," said Sean Holden.

"We have heard evidence that the money was put into his account without his knowledge or consent. Is that true?" the fiscal asked.

"No," replied Sean Holden. "No-one is going to put money into an account unless you know you are going to get it back. He was doing a good turn for us. The proceeds of the sale were Donna’s."

Sean Holden said his relations with his father at the time were good but that was no longer the case.

He also denied allegations by his father that he had phoned solicitors MacLeod and MacCallum pretending to be his father and giving bank details so the proceeds of the sale could be paid into his father’s account.
