Ohio's Master of Disaster Faces Disbarment
Stanley Chesley, the lawyer nicknamed “the master of disaster” who some consider to be the father of the modern-day mass tort, may no longer be able to practice law in Kentucky, and possibly elsewhere.
Chesley, of Cincinnati, rose to fame in legal circles after representing families of those who died in the 1977 Beverly Hills Supper Club fire in Kentucky.
Yesterday, the Kentucky Bar Association board of governors voted to disbar him for allegedly taking more than his share – $7 million, to be exact in fees from a 2001 diet drug settlement. This story in the Lexington Herald-Leader has the details. ( Here’s Chesley’s law-firm bio page.)
Sheryl Snyder , a lawyer for Chesley, said the decision was just a recommendation and told the Herald-Leader that he will ask the Supreme Court to hear oral arguments in the disciplinary matter.
Years ago, Chesley inserted himself into the high-profile case of drug-maker American Home Products, which faced numerous federal and state suits over the diet drug fen-phen, which was later banned for causing heart-valve problems.
The suit ended in a $200 million settlement. Plaintiffs attorneys took a steep 49% of the settlement and 440 clients split the rest. Two of the attorneys are now in prison for taking more of the fees than they deserved, another was acquitted of those charges. Chesley has never been charged with a crime in the case.
Chesley was late to come to the fen-phen suit but convinced the other plaintiffs attorneys he should be involved because of his experience in mass torts. He earned his keep, convincing Boone Circuit Court Judge Joseph Bamberger to boost attorneys’ cut to 49% of the total settlement in a February 2002 clandestine meeting in the courthouse jury room, according to a bar association report. Clients weren’t told of the new arrangement. And Chesley received an additional $4 million payment out of the fees.
Judge Bamberger later resigned and testified he never would have approved the fees had he known there was a prior, lower fee arrangement.
Chesleys reach has been far and wide since he developed what was then a ground-breaking new tactic in the 1977 Beverly Hills Supper Club fire case of suing more than 1,000 defendants, most of them companies that had sold supplies or services to the club, eventually securing nearly $50 million in settlements and court awards. His strategy became a blueprint for how plaintiffs’ attorneys pursue mass torts — gathering large numbers of plaintiffs and casting a wide net for potential defendants.
